Terms of Service

Welcome to Buildra ("Buildra," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

To use the Service, you must be at least 18 years old and capable of entering into a binding contract. If you sign up on behalf of a business, you represent that you have authority to bind that business to these Terms. You agree to provide accurate, current, and complete information when registering and to keep that information up to date. You are responsible for maintaining the security of your account credentials.

You agree not to:

• Use the Service to violate any law or third-party right.
• Upload content that is unlawful, infringing, defamatory, or malicious (including malware, viruses, or scraped content you don't have rights to).
• Attempt to reverse engineer, scrape, or otherwise circumvent technical measures protecting the Service.
• Interfere with the operation of the Service or place unreasonable load on our infrastructure.
• Resell, sublicense, or otherwise commercialize the Service except as expressly permitted by your subscription plan.

How billing works. Paid plans are charged in advance on a recurring monthly or annual basis at the rate shown at sign-up. Payment processing is handled by Stripe; by providing payment information you also agree to Stripe's end-user terms. You authorize Buildra to charge your saved payment method for all fees due, including applicable taxes.

Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, until you cancel. You can cancel auto-renewal at any time from /settings/subscription. Cancellation stops future charges; you keep access through the end of your current paid period.

Free trial. If a free trial is offered at sign-up, your saved payment method will be charged at the end of the trial period unless you cancel before then. We will send you a reminder email at least three (3) days before any trial-ending charge.

Price changes. If we change the price of your plan, we will email you at least seven (7) days before the new price takes effect on your subscription. You may cancel before the new price applies.

Refunds. See our Refund Policy for full details. In short: 14-day money-back on first-time monthly subscriptions, 30-day money-back on first-time annual subscriptions, no questions asked. After that window, fees are non-refundable except where required by law (or under the limited service-disruption / billing-error exceptions in the Refund Policy).

How to cancel. Cancel any time at /settings/subscription or by emailing support@buildra.app. No phone calls or sales-retention steps are required.

California residents: Pursuant to California Business & Professions Code §17602, this section discloses the auto-renewal terms. By starting a subscription you affirmatively accept these terms. You may cancel before the next renewal at the link above with no further obligation.

You may cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, fail to pay when due, or use the Service in a way that could expose us or third parties to liability. Upon termination, your right to use the Service ends immediately; you can export your data for a limited period as described in our Privacy Policy.

You retain ownership of all content you upload or generate through the Service (your "Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your Content solely as needed to provide the Service to you and to improve the Service in a manner consistent with our Privacy Policy.

Buildra, our logo, and all software, designs, and materials we provide are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-transferable, non-exclusive, revocable license to use the Service in accordance with these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL ENGINEERING, LEGAL, OR FINANCIAL ADVICE. YOU ARE RESPONSIBLE FOR REVIEWING ALL OUTPUTS AND DECISIONS BEFORE ACTING ON THEM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BUILDRA'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100). WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You agree to indemnify, defend, and hold harmless Buildra and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your Content, or your breach of these Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware.
